These Supplemental Terms govern your optional use of MyDevoted Chat (Beta), an experimental feature offered by Devoted Health, Inc. and its subsidiaries and affiliates (“Devoted”). These Supplemental Terms supplement and are incorporated into the Devoted Health Platforms Terms of Use (the “Master Terms”). Capitalized terms not defined here have the meaning in the Master Terms. If these Supplemental Terms conflict with the Master Terms for matters related to MyDevoted Chat, these Supplemental Terms control.
1. Eligibility; Optional Enrollment
1.1 Optional. MyDevoted Chat is optional and not required to use or access Devoted benefits or services.
1.2 Eligibility. MyDevoted Chat is available to individuals aged 18+ located in the United States and may be limited to certain plans, markets, features, or timeframes.
1.3 Beta Status. MyDevoted Chat is a Beta feature and may change, break, be unavailable, or be discontinued at any time without notice.
2. Description of MyDevoted Chat
2.1 Purpose. MyDevoted Chat uses parts of your Devoted member record (e.g., claims, labs, visits, notes) and other connected sources to help you: (a) notice patterns across time and sources; (b) understand what’s changing and why in plain language; and (c) prepare for visits and questions.
2.2 No Medical Advice. MyDevoted Chat provides informational summaries only. It does not provide medical advice, diagnosis, or treatment recommendations. Always consult your clinician for decisions about your care or medications. Do not use MyDevoted Chat in emergencies—call 911 (or your local emergency number). Devoted makes no warranties or guarantees regarding the effectiveness, completeness, or suitability of the information for your specific health needs.
3. Data Sources; AI Processing
3.1 Sources. MyDevoted Chat may use your plan data (e.g., claims), lab results, visit summaries, medication history, and other records Devoted maintains or lawfully receives, and data you choose to connect or provide.
3.2 AI Features. MyDevoted Chat processes your data using AI/ML systems to generate plain-language explanations and surface patterns. Outputs may be incomplete, outdated, or inaccurate and should be verified with your clinician before being relied upon for action.
3.3 Improvement & Safety. Devoted may use available data, queries you have entered, usage telemetry, and error reports to maintain, secure, troubleshoot, and improve MyDevoted Chat, evaluate quality, and monitor abuse and safety.
3.4 Model Training: Devoted may use available MyDevoted Chat data to improve MyDevoted Chat and related systems. Devoted will not use your identifiable PHI to train or improve third-party, general-purpose artificial intelligence models (often referred to as 'foundation models') intended for broad public or commercial use.
4. Your Responsibilities
4.1 Accuracy. Review MyDevoted Chat content for accuracy.
4.2 Sharing. If you download, export, or share content (e.g., screenshots), you are responsible for where it goes.
4.3 Appropriate Use. Do not misuse, probe, or reverse-engineer MyDevoted Chat or underlying systems; do not attempt to circumvent controls or rate limits. MyDevoted Chat may not be used to generate illegal content, incite violence, or engage in other harmful activities.
4.4 Clinical Decisions. Do not start, stop, or change medications or treatment (including diet and exercise) based on MyDevoted Chat; discuss with your clinician.
5. Privacy; HIPAA
5.1 Privacy Policy. Your use of MyDevoted Chat is subject to Devoted’s Privacy Policy: https://www.devoted.com/privacy-policy/.
5.2 HIPAA. Where MyDevoted Chat processes your information as part of Devoted’s health plan or clinical operations, such processing is subject to applicable privacy and security requirements under HIPAA and other applicable laws.
6. Beta Disclaimers; Availability
6.1 “As Is.” MyDevoted Chat is provided as is and as available, without warranties of any kind, in addition to the disclaimers in the Master Terms. AI outputs may be wrong, outdated, or incomplete.
6.2 Service Changes. Devoted may add, limit, or remove features; throttle usage; or suspend MyDevoted Chat at its discretion. Devoted may impose usage or rate limits to protect members and systems.
7. Limitation of Liability (MyDevoted Chat)
To the maximum extent permitted by law, Devoted and its subsidiaries and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of data, profits, goodwill, or other intangible losses arising from or relating to your use of MyDevoted Chat, its availability, or its outputs. These limits are in addition to the limitations in the Master Terms.
8. Feedback
If you provide feedback, suggestions, or bug reports about MyDevoted Chat, you grant Devoted a worldwide, royalty-free, irrevocable, perpetual license to use and incorporate that feedback without restriction or compensation.
9. Suspension; Termination
Devoted may suspend or terminate your access to MyDevoted Chat at any time. You may stop using MyDevoted Chat at any time. Sections 2, 3, 5–9 survive termination to the extent permitted by law.
10. Priority; Changes
10.1 Priority. For MyDevoted Chat-specific issues, these Supplemental Terms control over conflicting terms in the Master Terms.
10.2 Updates. Devoted may update these Supplemental Terms. Your continued use of MyDevoted Chat after an update constitutes acceptance.
